Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Tixified platform. By accessing or using our service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using Tixified, you confirm that you are at least 18 years old and agree to these Terms. If you are using Tixified on behalf of an organization, you represent that you have authority to bind that organization.

2. Description of Service

Tixified provides an event ticketing and management platform that allows organizers to create events, sell tickets, manage attendees, collect registration data via custom forms, and integrate with CRM systems.

3. Account Responsibilities

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Ensuring the accuracy of information you provide
  • Complying with all applicable laws and regulations

4. Payments and Billing

Subscription fees are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law. We reserve the right to change pricing with 30 days notice.

5. Ticket Sales

You are solely responsible for the events you create and the tickets you sell. You must comply with all applicable laws regarding refunds, consumer protection, and event cancellations. Tixified is not liable for disputes between organizers and ticket buyers.

6. Data Collection & Privacy Compliance

Tixified enables you to create custom registration forms that collect personal data from your attendees. You, the organizer, are the data controller for all personal data collected through your forms. Tixified acts solely as a data processor on your behalf.

6.1 Your Data Protection Obligations

As a data controller, you agree that you are solely responsible for:

  • Ensuring you have a lawful basis (e.g., consent, legitimate interest, contractual necessity) for collecting all personal data through your registration forms
  • Providing clear and conspicuous privacy notices to your attendees before or at the point of data collection
  • Responding to data subject access requests (DSARs), deletion requests, and other rights exercised by your attendees
  • Implementing appropriate technical and organizational security measures to protect the data you collect
  • Notifying affected individuals and applicable authorities of any data breach involving data you control, within the timeframes required by applicable law
  • Ensuring that any cross-border data transfers comply with applicable transfer mechanisms (e.g., Standard Contractual Clauses, adequacy decisions)

6.2 Applicable Legal Frameworks

You acknowledge and agree that the data you collect through Tixified may be subject to one or more of the following legal frameworks, and you are solely responsible for compliance:

  • General Data Protection Regulation (GDPR — EU/EEA): Applies when collecting data from individuals in the European Union or European Economic Area. Regulates the processing of personal data including special category data under Article 9 (health, race, religion, political opinions, sexual orientation, biometric data, trade union membership).
  • Health Insurance Portability and Accountability Act (HIPAA — US): Applies to protected health information (PHI). If you collect health-related data (medical conditions, allergies, dietary restrictions due to health, insurance information), you may be subject to HIPAA requirements.
  • California Consumer Privacy Act / California Privacy Rights Act (CCPA/CPRA — US): Applies to personal information of California residents. Provides rights including access, deletion, opt-out of sale, and limits on use of sensitive personal information.
  • Payment Card Industry Data Security Standard (PCI-DSS): Applies to any collection, storage, or processing of payment card data. You may NOT collect payment card numbers, CVVs, or expiration dates through registration forms. All payment processing is handled exclusively through Tixified's integrated payment processors.
  • Biometric Information Privacy Act (BIPA — Illinois, US): Applies to biometric data such as fingerprints, retina scans, or facial recognition data. Requires informed written consent before collection.
  • Children's Online Privacy Protection Act (COPPA — US): Applies if you collect personal information from children under 13. Requires verifiable parental consent.
  • Personal Information Protection and Electronic Documents Act (PIPEDA — Canada): Applies when collecting personal information of individuals in Canada in the course of commercial activity.
  • Lei Geral de Proteção de Dados (LGPD — Brazil): Applies when processing personal data of individuals in Brazil. Provides similar protections to GDPR.
  • UK GDPR / Data Protection Act 2018 (UK): Applies when processing personal data of individuals in the United Kingdom post-Brexit.
  • State Privacy Laws (US): Various US states (Virginia VCDPA, Colorado CPA, Connecticut CTDPA, Utah UCPA, and others) have enacted comprehensive privacy laws. You must comply with all applicable state laws based on where your attendees reside.

6.3 Prohibited Data Collection

You are expressly prohibited from using Tixified registration forms to collect:

  • Social Security Numbers (SSN) or national identification numbers
  • Credit/debit card numbers, CVVs, or full payment account details
  • Bank account numbers, routing numbers, IBAN, or SWIFT codes
  • Passport or driver's license numbers
  • Passwords, PINs, or security codes
  • Tax identification numbers (TIN, EIN)

Tixified employs automated scanning to detect and block prohibited data fields. Attempts to circumvent these controls may result in immediate account termination.

6.4 Sensitive Data Collection

Certain categories of personal data are considered "sensitive" or "special category" under applicable laws. These include but are not limited to: health/medical information, racial or ethnic origin, religious beliefs, political opinions, sexual orientation, biometric data, criminal history, and trade union membership.

If you choose to collect sensitive data, you must:

  • Acknowledge the regulatory implications through Tixified's sensitive data acknowledgment workflow
  • Obtain explicit, informed consent from data subjects where required
  • Implement additional safeguards appropriate to the sensitivity of the data
  • Limit collection to what is strictly necessary for your stated purpose

6.5 Indemnification for Data Collection

You agree to indemnify, defend, and hold harmless Tixified, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, fines, penalties, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your collection, use, storage, or processing of personal data through Tixified
  • Your failure to comply with applicable data protection laws
  • Any regulatory investigation, enforcement action, or penalty related to data you collected
  • Any data breach resulting from your actions or negligence
  • Claims brought by your attendees or third parties regarding data you collected

7. Prohibited Uses

You may not use Tixified to:

  • Engage in fraudulent or deceptive activities
  • Violate any applicable law or regulation
  • Infringe on intellectual property rights
  • Transmit harmful, offensive, or illegal content
  • Attempt to gain unauthorized access to our systems
  • Collect prohibited categories of personal data as defined in Section 6.3
  • Circumvent or attempt to bypass data compliance safeguards

8. Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms, including but not limited to violations of data collection policies. You may cancel your account at any time through the billing settings.

9. Limitation of Liability

To the maximum extent permitted by law, Tixified shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service. This includes, without limitation, any damages arising from data collection practices conducted by you through the platform.

10. Disclaimer of Warranties

Tixified provides data compliance scanning and sensitive data acknowledgment tools on an "as-is" basis as a convenience feature. These tools do not constitute legal advice and may not detect all prohibited or sensitive data patterns. You remain solely responsible for ensuring your data collection practices comply with all applicable laws, regardless of whether Tixified's tools flag specific fields.

11. Governing Law

These Terms are governed by the laws of the jurisdiction in which Tixified operates, without regard to conflict of law principles.

12. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or in-app notification. Continued use of Tixified after changes take effect constitutes acceptance of the updated Terms. You may be required to re-accept updated Terms to continue using the platform.
